On registering for the KYC360 Online AML Community (hereafter "the Website") you will be bound by these terms and conditions and agree to them. Using or accessing this website indicates your continuing acceptance of these terms and conditions. KYC Active Limited (hereafter "We"/"Us") may change these terms and conditions at any time by updating this page. You should check from time to time to review these terms and conditions to ensure that you are happy to continue using the website under the changed terms and conditions. If you do not accept the terms and conditions applying please do not continue to use the website.
Membership
Membership of the Website is open to financial services professionals and government organisations. The Website is not for use by children and is not directed at children.
We reserve the right to refuse any membership application or revoke membership for any reason and we are under no obligation to divulge that reason to any member or applicant.
Access
- Your user name and password must only be used by you, keep them safe. If a posting is made using your name and password it will be considered to have been posted by you.
- Sharing of accounts, concurrent usage or other access code sharing is NOT permitted.
- You shall not copy, modify, disclose, make available or use the Website except as provided in these terms and conditions.
- You shall not commercially exploit the Website or any of its content by for example selling, transferring, licensing for use by others or re-branding any of its content.
- You shall not remove any copyright or similar notice contained in the Website.
- It is your responsibility to make sure that the computers from which you intend to use the Website meet the hardware, software and security settings requirements for effective use of the Website.
- We may change the Website (including without limitation its format) and anything described in it without notice to you.
- Each time you use or log on to the Website you confirm your acceptance of the Terms and Conditions of the Website.
- You are responsible for bringing the Terms and Conditions of use of the Website to the attention of all users in your employment accessing the Website.
Passwords
- KYC Active Ltd shall provide usernames and passwords to enable authorised users to access the Website. You shall ensure that such usernames and passwords are only used by the named, authorised users and are kept secure and confidential. Access to and use of password protected or secure areas of the Site is restricted to authorized users only. You may not share your password(s), account information, or access to the Website. You are responsible for maintaining the confidentiality of password(s) and account information, and you are responsible for all activities that occur under your password(s) or account(s) or as a result of your access to the Website. You agree to notify us immediately of any unauthorized use of your password(s) or account(s).
Security and Accuracy of the Website
- You must not in using the Website send to the Website any viruses, trojan horses, trap doors, back doors, easter eggs, worms, time bombs, cancelbots, cross-site script attacks or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information.
- We reserve all rights to all software associated with, comprised in, and used to operate the Website ("the Software"). Your use of the Website shall not imply the grant to you of any rights in or in respect of the Software. The Software is protected by copyright and other intellectual property rights.
- You will not disassemble, decompile, or reverse engineer, the Software.
- We make no warranty express or implied that;
- Your access to the Website will be uninterrupted, timely or error-free;
- The Website will be compatible with any hardware and software used by you; or
- The Website is error free or that the information contained on its pages from time to time is complete, accurate or up-to-date. Under no circumstances do we accept any liability whatsoever and howsoever occurring in relation to any of the content which appears on the Website from time to time.
- We do not accept any liability for any inaccuracies, errors or omissions in the Website or any of its content. In particular we do not warrant or represent that the use of the Website will meet all or any particular subset of your legal or regulatory or compliance obligations.
Discussion Forum
In order to participate in and contribute to selected communities on the Website you will be required to register with KYC360. Any personal information supplied to KYC360 as part of this registration process and/or any other interaction with KYC360 will be collected, stored and used in accordance with our Privacy Policy.
- You agree to use the Website (including discussion forums) in accordance with the following Rules.

About your posts:
- Contributions must be civil and tasteful.
- No disruptive, offensive or abusive behaviour: contributions must be constructive and polite, not mean-spirited or contributed with the intention of causing trouble.
- No unlawful or objectionable content: unlawful, harassing, defamatory, abusive, threatening, harmful, obscene, profane, sexually oriented, racially offensive or otherwise objectionable material is not acceptable.
- No spamming or off-topic material: we don't allow the submission of the same or very similar contributions many times. Please don't re-submit your contribution to more than one discussion, or contribute off-topic material in subject-specific areas.
- No advertising or promoting.
- Contributions containing languages other than English may be removed.
- No impersonation.
- No inappropriate (e.g. vulgar, offensive etc) user names.
- URLs (web site addresses) can only be posted if not advertising or promoting.
- Content which abuses, threatens, promotes, or instigates physical harm or death to others, or yourself;
- Posts must not infringe on any patent, trademark, copyright, right of publicity, or other intellectual property right of any party.
- We retain ultimate editorial control.
Content of the Website and our liability
- The content of the Website is intended for guidance only and nothing on the Website shall constitute advice or a recommendation.
- The content of the Website and the sources of such content may change from time to time and parts of the Website may contain third party content.
- We have put in place security measures for your protection. In accordance with our security statement and to the extent permissible by law we shall not be liable for any failure resulting from a failure of those security measures howsoever occasioned. To the extent permissible by law we shall also not be liable for damage to, or for viruses or other code that may affect, any computer equipment, software, data or other property as a result of your access to, use of or browsing of, the Website or its downloading of any material from it. We shall also not be liable for the actions of third parties in breaching any security measures.
- To the extent permissible by law, we shall not be liable to you for any losses (including, without limitation, direct, indirect or consequential losses, damages for loss of business, goodwill, opportunity or loss of profits) arising in contract, tort or otherwise from the use of or inability to use the Website, or any material contained in it or accessible from it, or from any action or decision taken as a result of using the Website or any such material.
- You acknowledge that we do not intend that users draw any negative inferences about individuals or entities identified on the Website and you shall not draw such inferences merely because persons are shown as being linked to others profiled or identified on the Website. We make no warranty or representation about and disclaims all liability for the accuracy, completeness, currency or lawfulness of any information originating from external Internet sites, press and public sources.
Intellectual Property and Confidentiality
- All intellectual property and other proprietary rights, including design right and copyright, in and relating to the Website and the content of the pages of the Website are owned or controlled by us, except in the case of externally sourced articles which remain the property of their respective publishers and where alternative copyright information is displayed explicitly. In accessing the Website You agrees that it may only download the content for its own use in accordance with these terms.
- Except as provided by clause 29, you are not permitted to copy, broadcast, download, store (in any medium), transmit, show or play in public, adapt or change in any way or create derivative works from the content of the web pages for any purpose whatsoever without our prior permission.
- The KYC360 name and logo and all related names, design marks and slogans are the trade marks or service marks of KYC Active Ltd.

Neither party shall disclose confidential information belonging to the other to
any third party. The obligations of confidentiality contained in this clause
shall not apply to information which:
- is known to the recipient at the time of disclosure; or
- is lawfully received or developed by the recipient without obligations of confidentiality;
- is required to be disclosed to law enforcement or regulatory authorities.
- You are permitted to print and retain printed copies of search receipts from the Website in order to meet statutory record retention requirements.
Third Party Websites
- We have no control over, and accept no responsibility for the content of any website to which a link from the Website exists. The links are provided "as is" with no warranty, express or implied, for the information provided within them.
- You must not frame any of the Website into any other website.
Severability
- If any of these terms should be determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction which that term is illegal, invalid or unenforceable, it shall be severed and deleted and the remaining terms of use shall survive, remain in full force and effect and continue to be binding and enforceable.
Governing Law
- These terms of use shall be governed by and construed in accordance with the law of Jersey. You submit to the non-exclusive jurisdiction of the Royal Court of Jersey to settle any dispute which may arise under these terms of use.
